Terms & Conditions
These Terms & Conditions ("Terms") govern your use of Samth eSim's website, mobile applications, and eSIM services (together, the "Service"). By creating an account or purchasing a plan, you agree to these Terms. If you do not agree, do not use the Service.
1.The Service
Samth eSim sells prepaid eSIM data plans for use in 190+ countries. Each plan provides a defined amount of mobile data, valid for a specified period within a specified geographic coverage area, delivered as an eSIM profile (QR code or universal link) provisioned on your device by one of our network partners.
2.Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Service. By using the Service you confirm that you meet these requirements. Plans are sold for personal, non-commercial use unless we have agreed otherwise in writing.
3.Account Registration
You create an account by providing a valid email address; we send you a one-time magic link or code for sign-in. You are responsible for keeping your sign-in method confidential and for all activity on your account. Notify us immediately at support@samthesim.com if you suspect unauthorized access.
4.Device Compatibility
The Service requires an eSIM-compatible, carrier-unlocked device. You are responsible for verifying your device's compatibility before purchase; we publish a compatibility list in our Help Center. We are not liable if your device cannot install or use the eSIM due to a hardware, software, or carrier-lock issue we did not cause.
5.Prices and Payment
Prices are displayed in US Dollars (USD) and may be converted to your local currency at checkout. We currently charge in Azerbaijani Manat (AZN) at the conversion rate published on our site at the time of purchase. Card processing is handled by a PCI-compliant payment provider (see our Privacy Policy for the full processor list). All prices include applicable taxes unless stated otherwise. Payment is due in full at the time of purchase. We reserve the right to change prices for future purchases without prior notice.
6.Refunds and Cancellations
Because eSIM data is delivered electronically and consumed immediately upon activation:
- Before activation: Unused eSIMs are fully refundable within 14 days of purchase. Contact support@samthesim.com with your order ID.
- After activation: Refunds are issued only if the eSIM is technically defective and we cannot resolve the issue within a reasonable time.
- Network and roaming issues: We are not responsible for outages, throttling, or coverage gaps caused by the local carrier, by your device, or by force majeure events.
- Promo credits and cashback: Are not redeemable for cash and may be revoked if obtained through fraud or abuse.
7.Acceptable Use
You agree not to:
- Use the Service for any illegal or harmful purpose
- Resell or commercially redistribute the eSIM without our prior written permission
- Attempt to bypass data caps, validity periods, or coverage restrictions
- Interfere with or disrupt the Service, our infrastructure, or any partner network
- Use the Service to send spam, malware, or other harmful content
- Create multiple accounts to abuse promotional offers
- Misrepresent your identity or attempt to access another user's account
We may suspend or terminate accounts that violate these rules.
8.Plan Activation and Validity
A plan's validity period starts the earlier of (a) when the eSIM first connects to a supported network, or (b) a defined fallback period from purchase, as specified per plan. Unused data does not roll over after the validity period ends. Top-ups, when available, extend the validity according to the top-up plan's terms.
9.Coverage and Speed
Coverage is provided by our partner networks in each country and may change without notice. Speeds and availability depend on local conditions, signal strength, network congestion, and your device. We do not guarantee any specific throughput, latency, or uptime. Some plans may be subject to fair-use policies enforced by the underlying carrier.
10.Privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
11.Intellectual Property
All content on our site and apps (logos, copy, design, source code) is owned by Samth eSim or our licensors and is protected by intellectual-property law. You may not copy, distribute, modify, or create derivative works without our written permission.
12.Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the amount you paid for the plan giving rise to the claim. We are not liable for indirect, consequential, incidental, or special damages, including loss of profits, data, business opportunity, or goodwill. Nothing in these Terms limits our liability for fraud, gross negligence, or any liability that cannot be limited under applicable law.
13.Indemnification
You agree to indemnify and hold Samth eSim, its officers, employees, and partners harmless from claims, damages, and reasonable legal fees arising from your misuse of the Service, breach of these Terms, or violation of any law or third-party right.
14.Termination
You may close your account at any time by emailing support@samthesim.com. We may suspend or terminate accounts that breach these Terms, that we reasonably believe pose a security or legal risk, or that have been inactive for a prolonged period. Sections that by their nature should survive termination (e.g. Limitation of Liability, Intellectual Property, Governing Law) will continue to apply.
15.Changes to These Terms
We may update these Terms from time to time. Material changes will be announced by email and on this page at least 14 days before they take effect, unless a faster change is required by law. Continued use of the Service after the effective date constitutes acceptance.
16.Governing Law and Disputes
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-law rules. Any dispute arising from or relating to these Terms or the Service shall be submitted to the competent courts of Baku, unless mandatory consumer-protection law in your country of residence provides otherwise.
